Prohibited articles

 A prohibited item is an item that cannot be listed on mesencheres.ch, even if its sale is legal in Switzerland.

A potentially infringing item may infringe the rights of third parties, such as copyright or trademark rights, for example, and cannot be offered for sale on mesencheres.ch.

The list is updated regularly and incorporated by reference into these General Terms and Conditions of the mesencheres.ch platform. If you are unsure about the applicable legislation, please consult the relevant authorities or a solicitor.

The following items or activities are prohibited from being sold, rented or made available on mesencheres.ch:

- items inciting discrimination, violence and racial hatred
- illicit financial instruments
- lists of addresses, whether named or anonymous
- the sale of animals and animal parts, or items protected by international conventions
- items associated with cults
- adult-only items
- drugs of any kind and items associated with their use or manufacture
- dangerous and illegal substances
- the sale of alcohol
- tickets for shows (whether named or not)
- foodstuffs
- archaeological objects, fossils and minerals
- batteries and accumulators
- uniforms and equipment associated with an official role and which may be used illegally
- copies and counterfeits
- corrosive substances
- flammable liquids
- products that are toxic or harmful to human or animal health
- nicotine-based products and derivatives
- weapons and explosives
- radioactive materials
- compressed gases, whether non-flammable or flammable
- illegal surveillance equipment
- unauthorised copies, promotional copies and illegal recordings
- 35/70 mm film copies
- software test and evaluation copies
- counterfeit currency, stamps and other items, or reproductions thereof
- official documents issued by an official institution
- medicines
- fireworks
- human organs and body parts
- stolen or concealed goods
- lottery tickets
- credit cards
- unauthorised or unlocked cable decoders, or any other system enabling the illegal reception of television programmes
- decoding and decryption software or equipment intended for this purpose
- items inciting discrimination, violence and racial hatred
- mesencheres.ch prohibits the listing on its website of any material containing:
- incitement or provocation to commit crimes or offences
- incitement or provocation to discrimination, hatred or violence against a person or group of persons on the grounds of their origin or their membership or non-membership of a specific ethnic group, nation, race or religion.
- denial of the existence of crimes against humanity (Holocaust denial)
- offences against heads of state and diplomatic agents
- incitement to suicide
- defamation and insults
- mesencheres.ch also prohibits the posting on its website of advertisements promoting organisations that encourage such actions.

Furthermore, mesencheres.ch strictly prohibits the sale on its website of uniforms, insignia or emblems reminiscent of those worn or displayed by the Nazis, by members of an organisation declared criminal, or by a person convicted by a Swiss or international court of a crime against humanity.

As the sale and purchase of weapons and explosives are regulated and usually restricted to authorised individuals or companies, the sale of weapons, ammunition, military equipment, explosives and weapon parts is strictly prohibited on mesencheres.ch.

The same applies to hunting weapons, collector’s weapons, replicas and deactivated ammunition. mesencheres.ch also prohibits the sale of truncheons etc., as well as bladed weapons (switchblades, sabres, bayonets, swords, daggers, etc.).

Kitchen knives and letter openers may, in principle, be offered for sale on mesencheres.ch. Sellers must, however, check before listing any items that their knives are not classified as bladed weapons.

The sale of cultural property is prohibited on mesencheres.ch

The sale of cultural property is prohibited on mesencheres.ch if it meets the following criteria:

Cultural property classified as national treasures, which may only be taken out of the country on a temporary basis, as well as stolen or stolen art objects.

You must be able to prove the origin of the items in your possession. We remind you that the sale of goods acquired by fraudulent means makes you liable to a fine or a prison sentence.

mesencheres.ch will do everything in its power to support the efforts of the relevant authorities in tracing stolen or stolen goods offered for sale on its website.

Consequently, and in accordance with our personal data policy, mesencheres.ch will cooperate fully with the authorities in any investigation into users who attempt to sell such goods on our website.

mesencheres.ch prohibits the sale on its website of products designed to record, without their knowledge or consent, the private conversations of third parties, whether spoken, via cable or electronically (such as telephone ‘bugs’, ‘listening devices’, ‘mini-transmitters’, and ‘surveillance microphones’, as well as radio receivers capable of scanning radio frequencies, acoustic amplifiers and other such devices).

The exact reproduction of coins or banknotes that are legal tender in their respective countries is punishable under the criminal laws governing counterfeiting, even if the intention is not to produce counterfeit currency.

mesencheres.ch prohibits the sale of fireworks and other pyrotechnic devices.

Items of a paedophilic nature.

mesencheres.ch strictly prohibits the sale on its website of:

- video cassettes, DVDs, CD-ROMs and any other media depicting the nudity or sexuality of minors
- images, photographs, books, magazines and any other media depicting the nudity or sexuality of minors
- works of a pornographic and/or violent nature involving minors
- images or works featuring any person appearing to be a minor
- Possession of such images or any media containing paedophilic content is a criminal offence punishable by severe penalties under the law. By placing this type of advertisement online, you accept full responsibility.
- sexual services (prostitution, escort services, webcam or telephone).

Hygiene, comfort and beauty products, as well as dietary foods, may be offered for sale on mesencheres.ch provided that these products are not subject to a medical prescription and may be sold in Switzerland outside of a pharmacy. However, these products must not contain any dangerous, narcotic or psychotropic substances.

Dietary foods subject to a mandatory medical prescription and products or foods containing Ephedrine or Ephedra (registered trademarks).
Advertisements must be written exclusively in the languages used on the mesencheres.ch platform. Any advertisement that contravenes this rule will be removed immediately.

This list of items prohibited from sale is not exhaustive, and mesencheres.ch reserves the right to remove any advertisement which, in the administrator’s opinion, may breach the law or contravene internet ethics in any way.
